Welcome to Zhmary (“we,” “our,” “us”). These Terms and Conditions (“Terms”) govern your use of the Zhmary grocery and food delivery mobile application (“App”) and any services provided through it. By downloading, accessing, or using Zhmary, you agree to these Terms. If you do not agree, please do not use the App.
To use Zhmary, you must:
Be at least 18 years old or have the permission of a parent or legal guardian.
Provide accurate and complete registration details.
Use the app only within Afghanistan, where our services are available.
You must register an account to place orders:
You are responsible for maintaining the confidentiality of your login credentials.
You agree to provide accurate, up-to-date information.
We reserve the right to suspend or terminate accounts for false information or misuse.
Zhmary provides:
Grocery ordering and delivery services
Food ordering and delivery from partner restaurants
All services are subject to availability based on your location in Afghanistan.
Orders placed through the app are considered confirmed once payment is completed or accepted for cash-on-delivery.
Prices and delivery fees are subject to change and will be displayed before order confirmation.
Payment can be made via cash on delivery or any available in-app payment methods.
Deliveries are subject to availability, traffic, and weather conditions.
Estimated delivery times are provided for convenience and are not guaranteed.
If you are not available at the delivery address, your order may be canceled, and a fee may be charged.
Orders can only be canceled within a limited time after placement. Once prepared or dispatched, cancellation may not be possible.
Refunds, if applicable, will be issued through the original payment method or as store credit.
Zhmary reserves the right to cancel any order for reasons including, but not limited to, item unavailability, delivery limitations, or suspicious activity.
You agree not to:
Use the app for any unlawful or harmful purpose
Misuse or exploit promotional offers
Harass, abuse, or harm Zhmary staff or delivery personnel
Attempt to reverse-engineer or hack the app
All content, branding, and code within the app are the property of Zhmary and protected under Afghan and international laws. You may not copy, reproduce, or distribute any part of the app without written permission.
To the maximum extent permitted by law:
Zhmary is not liable for any indirect, incidental, or consequential damages arising from the use of the app.
We do not guarantee uninterrupted or error-free service.
Zhmary is not responsible for any issues arising from third-party services or vendors.
We may suspend or terminate your access to the app at any time without prior notice if you violate these Terms or for operational reasons.
Zhmary may update these Terms from time to time. Changes will be posted in the app. Continued use of the app after updates means you accept the revised Terms.
These Terms are governed by the laws of the Islamic Republic of Afghanistan. Any disputes shall be resolved in the courts of Kandahar, Afghanistan.
